Jammu, Mar 20: In a significant ruling, the High Court has decreed that if a candidate's initial engagement is not sanctioned by the competent authority, their services cannot be regularized.
The court's decision came in response to the case of Tasleem Arif, who was initially engaged as a consolidated worker based on the recommendation of a former Minister in the erstwhile State of J&K. Despite subsequent attempts for regularization and release of withheld wages, the court found that the engagement lacked proper authorization.
Justice Rajnesh Oswal emphasized the importance of adherence to legal procedures, stating that engaging a candidate without proper selection processes denies opportunities to other eligible candidates. The ruling reinforces the principle that services cannot be regularized if the initial engagement is not in accordance with the law.
Furthermore, the court noted the authorities' efforts to address backdoor engagements, affirming the legality of their actions and ultimately dismissing the petitioner's claims.
