Srinagar CAT Stays Transfer Order of Government Employee Amid Allegations of Political Influence and Sparks Social Media Debate


 

In a recent development, the Central Administrative Tribunal (CAT), Srinagar Bench, has stayed the transfer order of Mir Irfan Maqbool, an employee of the J&K School Education Department. The order, issued on November 22, 2024, directed Mir Irfan to return to his previous posting, which he challenged, claiming it was issued arbitrarily and under political pressure.


Represented by Advocates Ms. Inayat and Md. Mir Ishtiyaq, the applicant argued that the transfer order did not follow proper procedures and was influenced by local political interference, particularly from a local MLA. He further stated that the sudden transfer disrupted his professional and personal life, as he had been performing efficiently at his current posting.


The tribunal, led by Hon'ble Member D.S. Mahira, directed the respondents, including the Principal Secretary of the J&K School Education Department, to treat the application as a formal representation. They are instructed to address the grievance within two weeks, ensuring compliance with legal standards. Crucially, the tribunal ordered that Mir Irfan Maqbool should not be relieved from his current post until the respondents decide on his representation.

This case once again highlights the crucial role of the judiciary in safeguarding the rights of public employees and ensuring justice in administrative matters. The CAT has demonstrated the importance of upholding fairness, protecting individuals from arbitrary decisions, and addressing grievances efficiently.
